B-1: 2024 Employment Law Developments Impacting the Long-Term, Assisted Living, and Home Health Care Providers

Session Description:

This session will provide a high-level overview of the most significant employment law developments and legal trends impacting long-term, assisted living, home care, and hospice care employers. Presenters will discuss the U.S. Department of Labor’s Independent Contractor Rule and how it would increase the risk of worker misclassification; White Collar Exemption Rule that proposes to change the salary threshold for exempt employees. Common wage and hour mistakes employers make that have led to findings during U.S. DOL audits, and how to fix/avoid them will be discussed. Presenters will also review The NLRB’s Final Joint Employment Rule; Stericycle decision and impact on Employee Handbook policies; and an update on the FTC’s Proposed Non-Compete Rule. Our excellent panel of presenters will lead an engaging conversation that walks through industry-specific proactive steps employers can take to confidently respond to and reduce their risks of lawsuits or financial exposure in the face of a changing legal landscape.

Joshua Vaughn, Shareholder, Littler P.C.

Joshua C. Vaughn is an employment defense attorney who regularly represents and defends employers in collective, class, and hybrid actions brought under the federal Fair Labor Standards Act and state wage and hour laws. He has defended employers across the healthcare spectrum in state and federal courts throughout the United States, and regularly provides wage and hour advice for organizations who provide housing, services, and care to older adults.

Asher Brody, Owner, Cornerstone Living Memory Care Community

Asher Brody is the owner of Cornerstone Living Memory Care Community in New Tripoli, Pennsylvania. Asher worked in long-term care, starting as an Assistant Administrator, working his way up to Regional Director, and now Owner. With his knowledge and experience in long-term care, Asher co-founded ESHYFT in 2018, a per diem nurse staffing app. His experience lends a unique perspective as the facility owner and leader of a staffing platform.
